In spite of having so many women centric laws Feminists in India are not satisfied . They want more to so they keep trying by various permutation , combinations . Here again a Public interest Litigation is filed in Delhi High Court to criminalize marital Rape.
What is Marital Rape ? The feminist dictionary explains , when a husband forces wife to have sex or forcibly have sex with him. This is altogether a very confusing issue because then what is cohesive sex ? A couple indulge in all type of foreplay or making another person ready for sex . By criminalizing sex in marriage this kind of cohesive sex will be counted as Rape . Which means any time you make your wife ready for sex by showing love it will be marital rape . Also they are trying to make it gender specific again . They just assumed that sexual urge is only limited to husbands , wives does not have that urge . Moreover , wife never forces husband to have sex . Apparantly , all women centric laws are made on these assumptions . Men the usual suspects , women the innocent Goddesses . I used to head a community center for men and I have counseled innumerable men who complained in a very low tone that they were raped by their wives almost every night . Interestingly same wife when files a complaint mentions her husband as impotent in the complaint . Impotent if you do not want sex , rapist if you want sex . Scenario for men is really scary and disappointing. Why all of a sudden feminists are reminded of marital rape ? A few days ago Supreme Court gave guidelines about 498a . Through those guidelines a message was given that FIR should not be filed just like that , there should be proper counseling before filing FIR . There was a confusion by these guidelines that there won’t be arrests now under 498a . But that is not the truth 498a is still there , including the arrest part . As it was assumed that there won’t be any arrest so feminist came with another idea to make sure that husbands are arrested by any hook or crook .
One thing is very important to know here that anal sex is already declared unnatural and it is criminalized. A big LGBT movement is going on against IPC 377 . IPC 377 is mostly used by wives along with 498a to ensure arrest of husbands . In this kind of situation when a man has already nowhere to go wasn’t it a good idea to bring something for men first ? There is one more logic for marital rape issue that it is criminalized in other countries too . Answer to that hilarious logic is other countries have a gender neutral domestic violence law too . Where are we standing with all the biased laws towards women ? Our men did not even have the forum where they can go and complain if they have an abusive partner . Why Indian Feminists do not stand up for it , if it is really about equality ?
In year 2014 , The Hindu published a detailed report on how most rape cases are actually relationship gone wrong or sex on the pretext of marriage . If a general rape case has this kind of detail and the liar woman is never punished how we are ready to believe the wives ? In a marriage a man is forced into so many things , he has to sacrifice his hobbies , likes , dislikes just to make everyone happy . He has to spend his hard earned money on other members of the family . Then if anything goes wrong there are laws on his head . Every broken marriage is turned into either dowry or domestic violence case .When a case is filed his extortion starts in the name of case dates , maintenance and finally alimony . Wife gets money and share in property and man gets nothing . Isn’t that financial , legal , emotional and physical rape of a husband ? Why there is nothing to safeguard his rights ? Also why we are not making women accountable for anything ? Who will decide that it was rape or who raped whom inside the four walls of bedroom ? They are all set to bring bedroom into courtroom .
A whole DV law is for women where she gets right to residence , maintenance . This law Covers sexual violence against wife too then why do we need a separate law ? The only idea behind bringing up this new law is that this will be a new weapon to extort husband . Most of the marital disputes are settled with money , this will be another way to bring more money in settlement . In ours scriptures the idea of marriage is sacred , unlike others our marriages are not contracts . By bringing so many laws we have already corrupted it , one more law will make it worse . Before bringing any other laws let us think about men and punishing women , who make false accusations . In the words of Mr. Swaraj Kaushal who tweeted boldly on this ” There is nothing liem marital rape . Our homes should not become police stations .”
