What is the procedure for filling divorce in India?

    Divorces have become quite common in India today and most divorces happen with mutual consent of both the parties. According to Hindu Marriage Act 1956, section 13 provides for the grounds on which one can seek divorce but I would like to know about the procedure that is required to be followed while filling divorce petition in India?

    The procedure for filing divorce in India depends on the kind of divorce. If the divorce is taken with the mutual consent of both the parties, the divorce is granted merely by filing a divorce petition in the family court and is not a lengthy procedure but if it is not taken by the mutual consent of the parties, then after filing the divorce petition in the Family Court, the Court tries out the case and the couple is asked to remain separately for 6 months and if they still wants the divorce, then it is granted.
