RTI ACT 2005 Right to Information Act 2005 What is 'Right to Information' ? A part of Fundamental Rights under the “Freedom of Speech” as 'if one doesn't know one can't speak'. Empowers every citizen to seek any information from the Government. Inspect works, documents, records. Take notes, extracts or certified copies of documents or records. Take certified samples of material. Obtain information in form of printouts, diskettes, floppies, tapes, video , cassettes or in any other electronic mode or through printouts. What does 'Information' mean here ? “Information" means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force. Who can ask for 'Information'? Everyone having Indian Citizen. OCI’s – Overseas Citizens of India, can also ask for information under RTI act. PIO’s – Person of Indian Origin, can also ask for information under RTI act. State of Jammu and Kashmir is not included. Public Information officers (PIO) PIOs are officers designated by the public authorities in all administrative units or offices under it to provide information to the citizens requesting for information under the Act. How to seek Information ? Apply in writing or through electronic means in English or Hindi or in the official language of the area, to the PIO, specifying the particulars of the information sought for. Reason for seeking information are not required to be given. Pay fees as may be prescribed (if not belonging to the below poverty line category). Fee of application : Application fees to be prescribed which must be reasonable. If further fees are required, then the same must be intimated in writing with calculation details of how the figure was arrived at; Applicant can seek review of the decision on fees charged by the PIO by applying to the appropriate Appellate Authority; No fees will be charged from people living below the poverty line Applicant must be provided information free of cost if the PIO fails to comply with the prescribed time limit. How to submit application form ? Personally, by hand : Please ensure that you get your copy of the application and proof of payment duly stamped, signed and dated, either by the PIO or by the inward department. Registered Post AD: The AD card will act as proof of submission, after it is returned to you by the postal department. In case the AD card does not come back with a proper stamp, signature and date of receipt, follow up with the dispatching post office to get the AD card completed. Speed Post (A postal department service. Time limits : - For PIO to reply to application 30 days from date of receipt of application - For PIO to transfer to another PA under Sec 6(3) 5 days from date of receipt of application - For PIO to issue notice to 3rd Party 5 days from date of receipt of application - For 3rd Party to make a representation to PIO 10 days from date of notice from PIO - For PIO to reply to application if 3rdParty involved 40 days from date of receipt of application - For applicant to make First Appeal 30 days from date of receipt of PIO’s reply or from date when reply was to be received - For First Appellate Authority to pass an order 30 days from receipt of First Appeal OR Maximum 45 days, if reasons for delay are given in writing - For applicant to make Second Appeal before CIC/SIC 90 days from receipt of First Appeal orders or from the datewhen orders were to be received - For CIC/SIC to decide Second Appeal No time limit specified In case of "No response from PIO" : Every PIO will be liable for fine of Rs. 250 per day, up to a maximum of Rs. 25,000/-,for – Not accepting an application. Delaying information release without reasonable cause. Malafidely denying information. Knowingly giving incomplete, incorrect, misleading information. Destroying information that has been requested. this is a good initiative from the governments side so as to be more transparent towards the public. at the same time public can seek information from the governments side if there are any grievances. if RTI is effectively used by the indian citizens, corruption and delays of works can be minimized greatly.
Your saying is fine. But people do not use this act as they do not want to involve in useless controversy and investigation. they find it the waste of time and so they hardly use their right. and you are talking about the delays in work and reduction in corruption, then I don't think it can be done in a day or year or a decade. If we actually want the corruption to get the hell out of our country then it can only be done through sincere civil servants and by punishing the corrupted politicians and servants. No offence though
really a good initiative taken from the side of government to make help transparency prevail in the gov. people should utilize it optimally to ensure that public sector is working fine and efficiently, otherwise complaints could be lodged. it is our duty to make the best out of it as we are given that privilege
though such acts are enforced, they are not utilized completely by the citizens. most of them find it sluggish to do because they don't have time for their jobs itself. we should try to make the best use of such powers. if some people start initiating use of RTI, others would follow as this thing is new to people. and once everyone gets used to it, they may use it again and again.
RTI has a great importance especially to the poor people as they will know their rights through RTI and can take action against the officials who think that they can make a fool of poor people. Through RTI a poor people or a normal person has all the rights to know what and why and how the policy has been laid on the person. The government dealings and the common's peoples money in-charge and where all the money has gone and invested. All the queries are now can be answered and officials are held accountable for the same.
Right to information is an important right that is introduced in the country as through this poor people and people who pay heavy taxes should come to know about the money that they are paying is actually being used wisely! They can question any civil authority that where the public money is going and what is their salary and from where they are earning money in cumbersome? This is an important act that everyone should be aware about!
Right to information most popularly know as the RTI was an act passed in 2005. It is a noteworthy initiative of the government.
