Laws to prevent domestic violence

    There is domestic violence in every part of India. The women folk have to surrender under the power of the male. They are often going through tortures and severe curse. The women are not protected in their home. They get only curse, thrashing and beating from the male folk and from in-laws. Hence there are laws that are made to prevent the women from the domestic violence.

    Making a safer home

    Charity begins at home. Till our homes are not safer how can we expect our country to be? It’s the individuals that make up the nation. Domestic violence is the most prevalent form of crime in India. The women in most Indian homes are tortured and over 90% of this is underreported. The rest come to the fore front as they result in suicides. Any answers as to how should we proceed?

    domestic violence prevails in india since long time and it is quite rampant in remote areas of cities where men who get drunk and thrash their wives and children. there should be stringent laws against such violences as women are afraid of approaching law because the police do not take the matter seriously into consideration.

    You are right! Women are afraid of not only the men at home but also the policemen. They are afraid of not getting the justice and that too on time. The situation of police is not less than robbers who play with the emotions and the feelings of women. Domestic violence must be stopped and government as well as people should take strong steps to remove this.

    we do need stringent laws to prevent domestic violence as in india people living in the rural areas are into much of this domestic violence. most importantly ladies from the homes are the main victims of this violence and they are scared of approaching the law personnels as for the fear of being tortured by their families. so something needs to be done on this

    The expression Domestic Violence against women means any act or demeanor which has likely to injure or harm women physically, mentally, emotionally, socially and also spiritually inside the four walls of house; nevertheless such an act is not done generally by strangers. Section 32 (dd) of the Parsi Marriage Act, 1936 defines Domestic Violence. According to it, it means any act or commission or conduct which is of such a nature as to harm or has the potential to harming or injuring the health, safety or well being of the person aggrieved.
    The impact of domestic violence is to be deliberate by its degree of relentlessness. It is seen that domestic violence can succumb radical and intense fallout in the form of death, despite the fact that there may be trifling blemishes and injure in some cases and in some situations there may not be any death or even the minor scars but may cause psychological disaster. Under the IPC or the Criminal Law and the Civil Law as well, certain offences are considered as domestic violence against women. Some of those offences are:
    1. Dowry Death- Section 304-B IPC
    2. Forceful termination of pregnancy amounts to violence at home- Sections 313-316 IPC
    3. Marital Rape- Section 376-A IPC
    4. Matrimonial Cruelty- Section 498-A IPC
    5. Misappropriation of wife's property- Section 405 read with Section 406 IPC
    6. Unlawful Confinement- Sections 339 and 340 IPC
    7. Causing hurt and grievous hurt- Section 319 and Section 320.

    In fact indian law is 100% bais with woman , if any woman approches to the law , woman always get more mileage , i am not taking about rape( because its very difficult to proof it )
    The most recent example is Madrena at rajasthan - who lost every thing because of bhanwari devi , there are plenty of example as such

    Laws are already there its just that we are unaware or unable to use to get justice for victims. There is also other aspect of this a good % of cases of molestation, dowry, rape, eve teasing, are false accusations by women to get cheap benefits or revenge. So, if laws are made more stringent then we will see much more cases of legal exploitation of men, their family members &/or people dependent on them.

    Various cases are being reported everyday. Despite of making laws to prevent domestic violence, it is increasing at a great pace. It is mainly because women still fear the society and patriarchal society still exist in India where women are considered as a material object and not a human being. Moreover the Indian Judicial system lacks in many ways and the law protecting bodies, like the police also are not responsible. We need is a strong judicial system to curb such ill-treatment towards women.

    Laws are made to prevent domestic violence but unfortunately, Indian laws lack proper implementation and this is the major hindrance in curbing crime like domestic violence. Domestic violence is increasing in India despite of making laws and the only reason is the inefficiency and lack of proper functioning of the machineries of law. This can be easily tackled with proper implementation of law.
