Habeas Corpus is a writ issued by the Supreme Court and the High Court under article 32 and article 226. It is a latin terms which means “you have the body”. This writ or a legal action is filled often by the prisoner for releasing from unlawful detention. A writ of habeas corpus is a judicial consent to a prison official ordering that a convict be brought to the court so it can be resolute whether or not that person is incarcerated lawfully and whether or not he should be released from detention. A habeas corpus petition is a petition filed with a court by a person who opposes to his or anyone else’s detention or incarceration. The petition is required to prove that the court ordering the incarceration or detention made a lawful or truthful mistake.
