Right to privacy is an inherent right of every citizen and anyone who intrudes into another persons life or data or whatsoever it is, it is punishable under the provisions of law. Being an inherent right, I would like to know whether it comes under fundamental rights? If yes then under which article and what are the remedies against infringement of right to privacy?
Right to Privacy is a fundamental right under article 21 of the Indian Constitution, which provides "right to life and personal liberty". Right to privacy under this article was added after the landmark case Unni Krishnan vs State of A.P. The Supreme Court provided that right to privacy is a fundamental right and any infringement is punishable under law and one whose right to privacy is infringed can approach the High Court under Article 226 or the Supreme Court under Article 13 of the Indian constitution.
Any inherent right is a fundamental right and since right to privacy is an inherent right of every individual, it is definitely a fundamental right. Before the case of Unni Krishnan vs State of A.P, right to privacy was not declared as a fundamental right but after this landmark case, right to privacy along with many other rights were included under fundamental rights and infringement of fundamental right is punishable under law and even infringement of right to privacy is also punishable under law.
