Doctrine of Res Subjudice

    Section 10 of the CPC (Code of Civil Procedure, 1908 provides for the doctrine of Res Sub judice. Sub judice in law is a latin term which means "under judgement". According to this doctrine, if a case is pending in the Court, a new suit cannot be filed in the court for the same matter and among the same parties to suit.
