A couple with a child got divorced and the father was entailed to provide maintenance to both the child and the mother. However, the child is a minor and the father gave a demand draft in the name of the child. I would like to know if the mothers can encash the demand draft in name of minor child.

According to Indian Guardianship and Maintenance Laws, a mother can encash demand draft in name of minor child. All she needs to do is open an account in the name of the minor child in any nationalised bank by representing as guardian with necessary identification of herself as mother and fulfill the necessary requirements under Know Your Customer(KYC) norms and produce a certified copy of the court's order.
