Can a plaint be returned?

    Yes, a plaint can be returned at any stage of the suit, if the court find that it has no jurisdiction to the suit. Order of returning a plaint is appeal able. The Courts should sternly follow the procedure in cases where they approach to the wrapping up that the plaint should be returned for being presented to the Court in which the suit should have been instituted. The expression plaint would comprise of all the documents filed along with it. There is no procedure in CPC whereby the new court could call for the records.
