Appeal is a statutory right. It is the judicial examination of the decision by a higher court of the decision of an inferior court. It is a complaint made to the higher court that the decree made by the lower court is wrong, It is a remedy given by the law getting the decree of the lower court set aside. Right of appeal is a creature of the statute and unless it is granted clearly and expressly, it cannot be claimed by a person. It is a substantive right and not merely a matter of procedure. The first appeal lies on a higher court and the 2nd appeal lies only in the High Court and it relates to the substantial question of law.
